By using Album Dex ("the bot", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the bot.
Album Dex is a Discord bot that provides a gamified album collection experience. Users can:
- Catch randomly spawned album covers
- Build and manage their album collections
- Trade albums with other users
- Purchase tokens for premium features
- Suggest albums to server administrators
Important: Album Dex does not provide, store, or distribute music files, audio content, or any copyrighted material beyond album cover images used for identification purposes.
Eligibility
- You must be at least 13 years of age to use this bot
- You must comply with Discord's Terms of Service
- You must have permission to use the bot in Discord servers where it is installed
- If you are under 18, you must have parental consent to make purchases
User Conduct
You agree NOT to:
- Use the bot for any illegal purposes
- Attempt to exploit, hack, or reverse engineer the bot
- Use automated scripts or bots to interact with the bot
- Harass, abuse, or harm other users
- Spam commands or abuse the bot's features
- Impersonate other users or entities
- Violate any applicable laws or regulations
- Attempt to manipulate the economy or trading system unfairly
- Submit inappropriate, offensive, or copyrighted content as album suggestions
Account and Data
- Your album collection is tied to your Discord User ID
- Collections are server-specific (except for global albums)
- We reserve the right to remove data that violates these Terms
- You are responsible for any activity conducted through your Discord account
Intellectual Property
Album Covers and Content
- All album covers are the property of their respective copyright holders
- Album covers are retrieved from Last.fm for non-commercial, fan engagement purposes
- We claim no ownership of any album artwork, music, or related intellectual property
- Users do not acquire any ownership rights to album covers by collecting them
- Album collections are virtual and for entertainment purposes only
Bot Software
- The bot software, code, and related materials are owned by us
- You may not copy, modify, distribute, or create derivative works of the bot
- All rights not expressly granted are reserved
Purchases and Tokens
Token Purchases
- Tokens are virtual currency used within the bot for premium features
- Tokens can be purchased through Stripe payment processing
- Token prices are displayed at the time of purchase
- All sales are final unless required otherwise by law
No Real-World Value
- Tokens have no real-world monetary value
- Tokens cannot be exchanged for cash or refunded
- Tokens are non-transferable outside the bot's ecosystem
- We are not responsible for lost tokens due to user error or account issues
Refund Policy
- All sales are final
- Refunds may be granted at our sole discretion in cases of:
- Technical errors preventing token delivery
- Unauthorized purchases (must provide proof)
- Service unavailability for extended periods
- Refund requests must be submitted within 14 days of purchase
- Contact us with your purchase details to request a refund
Trading System
- Trades are conducted between users at their own risk
- All trades are final once accepted
- We are not responsible for trades you regret or consider unfair
- Attempting to scam or deceive other users in trades may result in account suspension
- We reserve the right to reverse fraudulent trades
Service Availability
- The bot is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service

Content and Album Suggestions
When suggesting albums to server administrators:
- You must have the right to share any content you submit
- You must not submit copyrighted material inappropriately
- Suggestions are subject to review and approval by server administrators
- We reserve the right to reject or remove any suggestions
- Inappropriate suggestions may result in account suspension
Server Administration
Server owners and designated album administrators have the right to:
- Approve or reject album suggestions
- Add or remove albums from their server collection
- Set spawn ratios and channel configurations
- Remove users' access to the bot in their server
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, or consequential damages
- We are not liable for lost profits, data, or revenue
- Our total liability shall not exceed the amount you paid for tokens in the past 3 months
- We are not responsible for third-party actions, including Discord or Last.fm service issues
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses arising from:
- Your use of the bot
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of applicable laws or regulations
Copyright Compliance
Fair Use
We believe our use of album cover images constitutes fair use under U.S. copyright law because:
- Use is transformative (gamified collection, not music distribution)
- Use is non-commercial in nature (free bot with optional purchases for premium features, not selling the artwork)
- Use involves only small portions (album covers, not music files)
- Use does not harm the market for the original work (may increase interest in albums)
DMCA Compliance
If you believe your copyright has been infringed, please contact us with:
- Identification of the copyrighted work
- Identification of the infringing material
- Your contact information
- A statement of good faith belief
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
We will respond to valid DMCA takedown notices promptly.
Termination
We reserve the right to:
- Suspend or terminate your access to the bot at any time
- Remove your data for violations of these Terms
- Ban users who abuse the bot or violate Discord's Terms of Service
You may stop using the bot at any time. Purchased tokens are forfeited upon termination.
Modifications to Terms
We may modify these Terms at any time. Changes will be posted with an updated "Last Updated" date. Material changes will be announced in relevant Discord servers where possible. Continued use after changes constitutes acceptance of the new Terms.
Dispute Resolution
- These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles
- Any disputes will be resolved through binding arbitration or small claims court
- You waive your right to participate in class action lawsuits
- Disputes must be filed within one year of the incident
Discord Terms
This bot is subject to Discord's Terms of Service and Developer Terms of Service. By using this bot, you also agree to comply with Discord's terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the bot.
